Agreement to sending marketing and advertising information

By sending this form, I hereby confirm that the data filled by me concern my person and I grant my agreement to processing of the personal data provided by me in the scope specified in the form (i.e. particularly my name, surname, phone number, and e-mail address) for the marketing purposes of the below specified companies, including sending (or other form of contacting including telephone contacting) marketing information as well as subsequent business offers related to sale of real estates, services provided in connection with real estates, and solutions for funding of a group of real estates by means of electronic communication, SMS etc. in accordance with sec. 7 of the Act no. 428/2002 Coll., on personal data protection, as amended. I give my agreement exclusively to the company FINEP SK a.s., Jégeho 12, 821 08 Bratislava, Company Id. No.: 35 931 914, the company FINEP FS a.s., organisation unit, Jégeho 12, 821 08 Bratislava, Company Id. No.: 44 400 829, and the individuals working for them. The personal data provided by me shall not be used for any other purposes than those exclusively specified. I hereby grant my agreement voluntarily and for an indefinite period. I also declare that I am fully competent and eligible for giving my consent, and as a party concerned, I am hereby informed on my rights in accordance with section 20 of the Act on personal data protection, particularly that I am entitled to request correction of incorrect, incomplete or obsolete personal data, or their cancellation, provided the purpose of their processing has been fulfilled or law has been breached, and I am entitled to withdraw my agreement with processing of my personal data in cases when their processing does not result from law, in written form sent to the address of the company FINEP SK a.s. or the company FINEP FS a.s., organisation unit.

Principles of Processing your Personal Data

Who we are

We process certain personal data for the provision of our services and the operation of our website.

The processing of personal data is particularly governed by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) („GDPR“).

 

I.Personal Data Processing

A.rocessing of personal data in case of using the contact form or other form of contact

If you inquire about our products and services, we will work with your contact details, which you will provide to us, for example via the inquiry form. These include: name, surname, e-mail, telephone number, and your requirements regarding our products and services, or other data that you fill in in your inquiry or provide to us as part of another agreement. 

For what reason?

We will use your personal data provided to us for contacting you regarding a further agreement on our services and products.

For what legal reason?

The reason is processing on the basis of Article 6(1)(b) of GDPR – contract negotiations and contract performance.

For how long will we process your personal data?

If we do not establish further cooperation, we will process your data for the time necessary to process your inquiry.

 

B. Processing of personal data in the case of concluding a contract

If we togehter enter into a conclusion of the contract, we will work with the data you provide to us.
These mainly include name, surname, e-mail, telephone number, address/registered office, the real property data, account number, in some cases it can also be a birth certificate number or identification card number, and other data that are necessary, for example, for real property transfer, assistance in arranging a mortgage or fulfilling obligations to prevent money laundering. 

For what reason?

We need to process personal data in order to fulfil our contract – to provide you with our products and services. We also use your contact details to communicate with you regarding the status of your matter or regarding complaints, grievances, wishes, or questions. 

We will further process personal data in order to fulfil our statutory obligations (mainly for accounting and tax purposes, for handling complaints, preventing money laundering, and for other reasons).

For what legal reason do we process your personal data?

The reason is personal data processing on the basis of Article 6(1)( b) of GDPR – performance of the contract – and Article 6(1)(c) of GDPR – fulfilment of our legal obligations.

For how long will we process your personal data?

For the period of performance of our services and 10 years after the last provision of our service, unless special regulations stipulate a different period, in which case the period shall be governed by this special regulation.

 

C. Newsletters (business communications)

If you subscribe to our newsletter or you are our customer and you have not refused to give us your consent, we can use your e-mail address to send you our news.

For what legal reason?

In the case of a subscription to the newsletter, we process your personal data on the basis of your consent and in compliance with Article 6(1)(a) of GDPR. 

If you are a customer, the provisions of Section 7(3) of Act No. 480/2004 Coll., on Certain Information Society Services, allow us to process your personal data, unless you prohibit us to do so.

Your consent is voluntary and can be revoked at any time. 

For how long will we process personal data?

D. Telephone contacting our clients with offers (telephone business communication)

If you are our client and you have not banned us from contacting you, we may do so from time to time via telephone calls.

For what legal reason?

If the processing of your personal data is for the purpose of providing our services, it is carried out in compliance with Article 6(1)(b) of GDPR, i.e. performance of a contract. 

If we contact you in order to offer other services or to determine the quality of our services, the processing is carried out in compliance with Article 6(1)(f) of GDPR, i.e. the so-called legitimate interest. 

How long will we process your personal data?

We will process your personal data for the period of providing our services and then 3 years after the last instance of provision of our service. You can file an objection against such processing. In this case, we will not contact you by phone for marketing purposes.

 

E. Taking photographs at events

Photos or videos can be taken at our events.

For what reason?

We want to capture our events for our internal purposes (archiving), as well as for promos on our website and social networks – Facebook, LinkedIn, and Instagram.

For what legal reason?

This is processing on the basis of Article 6(1)(f) of GDPR – processing on the basis of the so-called legitimate interest.

You can file your objection against such processing. Therefore, if you do not wish to be captured in the photos, contact us or the organizer/photographer at the venue.

 

F. Camera recordings

Some parts of our premises are guarded by a camera system.

For what reason?

We monitor areas where it is necessary to protect the health of people or, in exceptional cases, property. 

For what legal reason?

The reason is processing on the basis of Article 6(1)(f) of GDPR – processing on the basis of the so-called legitimate interest.

For how long will we process personal data?

Maximum 30 days from the date of making the recording.

II. Who will Get Access to our Personal Data?

Your data will be kept by us. Nevertheless, some companies or inpiduals who work for us can gain access to your personal data, because they help us with the running of our company. These are in particular:

  • suppliers and service providers,
  • financial institutions and banks,
  • state and other authorities during the performance of legal obligations.

We may provide your data to third parties if this results from our cooperation (i.e. the performance of the contract). These are, for example, credit providers, the land registry, the other contractual party, etc. In such cases, these are regarded as inpidual data administrators.

 

III. Your Rights Connected with the Processing of Personal Data

There is no appointed personal data officer in our group.

The GDPR gives you, among other things, the right to contact us and request information, which of your personal data we process, request access to your personal data, have the data updated or corrected, or request processing restrictions, you can request a copy of processed personal data, the deletion of personal data in certain situations and you have the right to personal data portability in certain cases. The consents granted may be revoked at any time and the processing may be objected to on the grounds of legitimate interest. 

If you think that we are not handling your personal data correctly, you have the right to file a complaint with the Office for Personal Data Protection, or you can even enforce your claims through the court.
